Literatur und Recht: Konstitutivität / Literature and Law: Constitutivity

Der Begriff der „Konstitutivität“ beschreibt ein wechselseitiges Verhältnis von Literatur und Recht, das sich in ihrer Entstehung, Prägung und Aufhebung manifestieren kann. Der Band untersucht, was diese in der Forschung seit Langem postulierte reziproke Konstitutivität tatsächlich umfasst, und eröffnet neue Perspektiven auf die Konzeptualisierung konstitutiver Beziehungen zwischen Recht und Literatur. Konstitutivität wird dabei neben Materialität und Komparativität als Teil einer dreiteiligen Taxonomie verortet, die die Beziehungen zwischen Recht und Literatur beschreibt. Der Band befasst sich zudem mit Fragen der Normativität von Recht und Genre, mit den Wechselbeziehungen von Recht, Literatur und (Post-)Nation in unterschiedlichen geografischen und historischen Kontexten sowie mit dem Verhältnis zwischen Recht und Buchmarkt.

The concept of “constitutivity” describes a mutual relation between literature and law, which manifests itself in their reciprocal initiation, shape, and abolishment. The volume examines what the long-held assumption of the mutual constitutivity of law and literature actually entails, thereby offering new perspectives on the conceptualization of their constitutive relations. Constitutivity is contextualised alongside materiality and comparativity as part of a tripartite taxonomy describing the relations between law and literature. The volume also addresses questions of the normativity of law and genre, the interrelations of law, literature and (post)nation across diverse geographical and historical contexts, as well as the relationship between law and the publication and distribution of books.
